Please read these terms carefully before using JewelMusic. By accessing or using our platform, you agree to be bound by these terms and conditions.
By creating an account or using JewelMusic's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our platform.
We reserve the right to modify these terms at any time. Continued use of the platform after any such changes constitutes your consent to such changes. We will notify you of material changes via email or through the platform.
You must be at least 18 years old or have parental/guardian consent to use our services
You must provide accurate, complete, and current information during registration
You are responsible for maintaining the confidentiality of your account credentials
You may not transfer your account or share access with others
One account per person or legal entity is permitted
You retain full ownership of all music, lyrics, artwork, and other content you upload to JewelMusic. We do not claim any ownership rights over your creative works.
By uploading content, you grant JewelMusic a non-exclusive, worldwide, royalty-free license to host, store, transmit, and distribute your content through our platform and partner distribution networks for the purpose of providing our services.
If you choose the revenue-sharing pricing tier, you explicitly grant permission for your anonymized content to be used for AI model training. This is separate from standard distribution licensing and requires affirmative consent.
By uploading content, you represent and warrant that:
You own or have obtained all necessary rights, licenses, and permissions for the content
The content does not infringe upon any third party's intellectual property, privacy, or other rights
The content complies with all applicable laws and regulations
The content does not contain harmful, defamatory, or illegal material
All royalty splits and collaborator credits have been properly documented
You agree not to:
Upload content that infringes copyrights, trademarks, or other intellectual property rights
Engage in stream manipulation, fake plays, or artificial streaming activities
Use bots, scripts, or automated tools to interact with the platform
Attempt to reverse engineer, hack, or compromise platform security
Misrepresent your identity or falsely claim affiliation with others
Upload content solely generated by AI without substantial human creative input
Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as expressly stated in these terms.
Royalties from streaming platforms are distributed according to your chosen pricing tier. Premium privacy tier users receive 100% of royalties. Revenue-sharing tier users receive between 80-85% based on their plan.
Royalty payments are made monthly once you reach a minimum threshold of $25. Earnings below this threshold are carried forward to the next payment period.
You are responsible for reporting and paying any taxes applicable to your earnings. We may request tax documentation as required by law.
JewelMusic distributes your content to digital streaming platforms (DSPs) including but not limited to Spotify, Apple Music, Amazon Music, YouTube Music, Deezer, and others.
We cannot guarantee acceptance by any particular platform. Each DSP has its own content policies which may result in content rejection. We will notify you if your content is rejected and provide guidance on resolution.
Distribution typically takes 1-4 weeks depending on the platform. Rush distribution is available for Enterprise tier customers.
You may cancel your subscription at any time through your account settings. Upon cancellation, your access continues until the end of the current billing period. Content already distributed will remain on platforms unless you request takedown.
We may suspend or terminate your account immediately for violation of these terms, suspected fraud, or illegal activity. We will provide notice unless immediate action is necessary to prevent harm.
Upon termination, you remain entitled to any unpaid royalties earned prior to termination. We will process final payments within 60 days of account closure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEWELMUSIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
Our total liability for any claims under these terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
These terms shall be governed by and construed in accordance with the laws of Georgia. Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in Batumi, Georgia, except where prohibited by local law.
Before initiating any legal action, you agree to attempt to resolve disputes through good-faith negotiation. You must contact us at legal@jewelmusic.art to initiate the dispute resolution process.
